Lokpal Challenges 1991 Supreme Court Ruling: A Turning Point for India?

Lokpal’s Recent Decision Raises Questions About Judicial Oversight

NEW DELHI: A recent ruling by a full bench of the Lokpal, led by former Supreme Court judge A.M. Khanwilkar, has sparked debate over the status of judges in constitutional courts. The decision confirms that these judges are considered public servants, a matter that was decisively addressed in a 1991 Supreme Court judgment known as the K. Veeraswamy case.

This latest ruling clarifies that judges from High Courts and the Supreme Court fall under the Lokpal and Lokayuktas Act of 2013. However, it also seems to contradict the earlier ruling from the Supreme Court which stated that no criminal cases can be initiated against judges without first consulting the Chief Justice of India (CJI).

The Supreme Court had previously emphasized that if allegations arise against the CJI, the government must consult another Supreme Court judge or judges. Moreover, the court outlined that any actions regarding the prosecution of judges should align with the advice given by the CJI to maintain judicial integrity.

The Supreme Court’s consensus was that all judges are public servants, and its ruling aimed to prevent misuse of legal proceedings against judges. In the context of governance, the CJI plays a crucial role in ensuring the judiciary remains fair and unbiased. The Supreme Court had stated that keeping the CJI informed would aid the government in making informed decisions if any criminal charges arose against a judge.

Additionally, the Supreme Court raised concerns about the potential damage to public trust in the judiciary if investigations involving judges were made public. It underscored the importance of using discretion in any actions taken under the Prevention of Corruption Act, ensuring that honest judges are shielded from harassment.

As this situation unfolds, it is clear that the relationship between judicial authority and accountability continues to be a critical topic of discussion in India.
