Trump Hits Back: Sanctions Imposed on Two ICC Officials Over Gaza and Afghanistan Investigations

Mamdani, Netanyahu, and the International Criminal Court

A recent discussion among Wall Street Journal columnists, including Paul Gigot, Kim Strassel, Kyle Peterson, and Elliot Kaufman, has shed light on New York City Mayor Zohran Mamdani’s initial support for an arrest warrant against Israeli Prime Minister Benjamin Netanyahu and his later retraction of that statement. The debate also touches on the International Criminal Court (ICC), as Secretary of State Marco Rubio emphasizes the U.S. government’s efforts to challenge its authority. There are growing concerns that the ICC’s actions may threaten U.S. sovereignty.

The Trump administration has taken steps to sanction two prominent ICC officials amid ongoing investigations into alleged U.S. war crimes in Afghanistan and arrest warrants for Israeli officials linked to the conflict in Gaza. Secretary Rubio labeled the ICC as “corrupt and fatally politicized” and expressed that their investigations violate the rights of nations that have not agreed to the court’s jurisdiction.

The sanctions, which target ICC President Tomoko Akane and senior trial lawyer Abdoulaye Seye, result in a freeze on their assets in the U.S. This means they can no longer engage in financial transactions within the country. In his remarks, Rubio stated, “Our campaign to dismantle the threat posed by the ICC to national sovereignty will be extensive, and we anticipate that more countries will join us in withdrawing support for this politicized court.”

These actions are rooted in an executive order from 2025 aimed at addressing what the Trump administration sees as the ICC’s overreach, particularly regarding individuals from non-member nations, including the U.S. and Israel.

The ICC, for its part, has responded strongly to these sanctions, asserting that they undermine the integrity of the legal process. The court claims that such actions threaten judicial independence and could impact victims seeking justice when local avenues have failed.

The ICC maintains that it has the jurisdiction to investigate crimes committed in territories of its member states, which include Afghanistan and Palestine. This allows the court to probe possible war crimes, including those allegedly committed by U.S. personnel in Afghanistan and Israeli officials in Gaza. Notably, the ICC has previously issued arrest warrants for Netanyahu and other Israeli leaders.
