India Welcomes Foreign Investment with New FDI Guidelines

New Delhi, August 21 (PTI) – India’s new rules allowing overseas firms with up to 10% Chinese shareholding to invest without prior approval have started to show promising results. So far, 29 foreign direct investment (FDI) proposals totaling around ₹4,895.65 crores have been reported, according to government officials.

These changes were notified by the finance ministry under the Foreign Exchange Management Act (FEMA) as of May 1, 2026. This reform allows for more streamlined and efficient foreign investment procedures in India.

The sectors benefiting from these investments include information technology, artificial intelligence, manufacturing, data centers, pharmaceuticals, and transport services, among others. The reported investments are coming from various places, such as Mauritius, the United States, South Korea, Japan, Singapore, Luxembourg, and the Cayman Islands.

The official stated that the updated framework significantly eases the process for foreign investors by eliminating the need for prior government consent in these cases. Now, investors can move forward using the automatic route, as long as they follow the necessary reporting guidelines.

This reform brings more clarity to foreign investors, reduces the time taken for transactions, and enhances the overall ease of doing business in India. According to the new guidelines, foreign companies with Chinese or Hong Kong shareholdings of up to 10% are allowed to invest in sectors where FDI is generally permitted through the automatic route, subject to specific sectoral conditions.

However, it’s important to note that these relaxed rules do not apply to businesses registered in China, Hong Kong, or any other nations sharing land borders with India. The countries sharing a border with India include China, Pakistan, Bangladesh, Nepal, Bhutan, Myanmar, and Afghanistan. Previously, foreign companies with even a single share held by someone from these bordering countries had to seek mandatory government approval to invest in any sector in India.
