Australia’s Most Decorated Soldier Faces Charges in Five War Crime Murders

Ben Roberts-Smith Faces Serious Charges

In Australia, Ben Roberts-Smith, the country’s most decorated living soldier, has been arrested and charged with five murders linked to war crimes that supposedly took place during his service in Afghanistan. The 47-year-old former Australian Defence Force member was taken into custody at Sydney Airport.

Roberts-Smith’s arrest has ignited a fierce debate. A former Australian Prime Minister expressed that it’s unjust to judge soldiers in combat by civilian standards. Elon Musk also shared his thoughts, calling the situation “insane.”

The Australian Federal Police, along with the Office of the Special Investigator, allege that Roberts-Smith was involved in the killings of five unarmed Afghan men in three separate incidents between 2009 and 2012. If found guilty, he could face life in prison for each charge.

“We believe the victims were not involved in combat when they were killed,” AFP Commissioner Krissy Barrett stated. “They were detained, unarmed, and under the control of ADF members.”

Details of the Investigation

The investigation into Roberts-Smith began in 2021, according to Ross Barnett, the director of investigations for the Office of the Special Investigator. He has a long history of bravery, having received the Victoria Cross for his actions in Afghanistan.

Barnett noted the investigation faced significant hurdles, as many of the incidents occurred over a decade ago and investigators were unable to access Afghanistan for further evidence.

Former Australian Prime Minister Tony Abbott voiced his support for Roberts-Smith, questioning why any alleged misconduct wasn’t addressed earlier and why it took so long for the issues to come to light.

Background of the Accusations

Allegations against Roberts-Smith emerged publicly in 2017 and 2018 through various media outlets. In a notable defamation case against these publications, Roberts-Smith faced scrutiny over claims regarding his actions. A Federal Court ruled that some of the allegations were indeed valid.

One troubling claim involved an incident where Roberts-Smith allegedly ordered the execution of an Afghan man after he survived a fall from a cliff.

The criminal charges against Roberts-Smith are part of ongoing investigations into war crimes linked to Australian Defence Force members. Currently, ten investigations remain active as part of this larger effort.
