Tighter Regulations for Energy Drink Labels in India
New Delhi, August 7—India’s food safety authority has made a crucial decision regarding the energy drink market, which is one of the fastest-growing sectors globally. The Food Safety and Standards Authority of India (FSSAI) announced that it will not extend the 90-day deadline for beverage companies to stop using the term “energy drink” on high-caffeine beverages. This move could greatly affect major brands like PepsiCo, Red Bull, Monster Beverage, and Reliance Consumer Products.
In July, the FSSAI set the deadline due to the lack of national standards for these products, stating that using the term “energy drink” is against regulations. With India’s energy drink market expanding at an estimated 12.6% annually—much higher than rates in the United States and China—this decision has created urgency within the industry.
Industry insiders revealed that companies are asking for at least one more year to adapt to these new rules, as many have millions of cans already on the market or ready to be imported. However, a government source indicated that many states believe existing inventories can be sold within 60 to 90 days.
Though the FSSAI acknowledged that there have been regulatory breaches, it clarified that these do not currently lead to any criminal charges or immediate actions against the companies involved.
Concerns Over Regulatory Seizures
Energy drinks are facing increased scrutiny worldwide due to their high caffeine and sugar content. There are proposals in England to ban these drinks for anyone under 16 starting next year. In India, the beverage industry is urging the government to halt the seizure of energy drinks by some states to maintain a steady supply.
Recently, thousands of units from brands like PepsiCo’s Sting, Reliance’s Campa Energy, and Red Bull were confiscated in Rajasthan during compliance checks. The local food safety authority in Ladakh is also planning similar actions.
The surge in India’s energy drink market began in 2017 with the launch of Sting, which quickly became popular among young people, especially in rural areas. Executives from leading beverage firms have met with Food Minister Chirag Paswan to discuss their concerns, emphasizing the need for an environment that encourages investment and innovation in the sector.
As the regulatory landscape evolves, the Indian government continues to grapple with balancing public health safety and industry growth.
