Supreme Court Supports Student Protesters by Allowing Case Withdrawals
NEW DELHI: The Supreme Court of India has taken a significant step toward easing tensions for student protesters. On Monday, the court granted permission to the Delhi government and other states to withdraw or dismiss police cases related to protests tied to the NEET exam paper leak. The court emphasized that these young individuals must be allowed to continue their education without the burden of legal worries.
This decision followed a clarification of a prior ruling from July 28, which had temporarily stopped law enforcement from taking strict actions against the protesters. At that time, students were understandably anxious about the potential future repercussions of ongoing cases against them.
During the recent court proceedings, Solicitor General Tushar Mehta stated that the government is committed to withdrawing cases against student protesters. He mentioned discussions on how to proceed with this process. However, Mehta pointed out that FIRs involving individuals with serious criminal backgrounds—such as those accused of violent crimes—would not be dropped.
Chief Justice Surya Kant highlighted that cases against students should be treated differently from those of other offenders to ensure their education remains uninterrupted. He noted the significant financial investment parents make in their children’s education and stressed the importance of not dragging young people into prolonged legal battles.
The Solicitor General agreed, stating that plans for the withdrawal of cases would be finalized soon. He cautioned that some individuals might try to stir up further disputes, so it’s crucial to handle the situation carefully.
Justice Bagchi mentioned that there are various ways to resolve this, including the prosecution filing a closure report or the public prosecutor recommending case withdrawals. Additionally, while an investigation into violent incidents during the protests will occur, the court aims to establish clear guidelines on using force in such situations, seeking recommendations from a newly formed committee.
The discussions around these matters continue, with senior advocates working toward a satisfactory resolution for the students involved. Overall, the Supreme Court’s actions signal a move towards understanding the unique challenges faced by student protesters.
