Supreme Court Blocks Order Regarding Alleged Art Trafficker
In a recent decision, the Supreme Court of India has temporarily halted a ruling by the Madras High Court concerning Subash Chandra Kapoor, who is accused of being an international art trafficker. The Madras High Court had instructed the central government to take Kapoor from Tiruchirappalli Central Prison and arrange for his return to Germany.
The Supreme Court’s bench issued a stay on the implementation of this High Court verdict, which had granted Kapoor’s habeas corpus petition. The High Court had stated that Kapoor’s ongoing detention in India related to previous offenses committed before he was extradited from Germany could not continue without approval from the German authorities.
Additionally, the High Court indicated that, when accounting for the time already served, Kapoor’s sentence in the extradition case was complete, with a custody record marking February 22, 2023, as the release date for that specific conviction.
