Judge Demands Indian Tycoon Gautam Adani Clarify Allegations of Deal-Making Motives

A federal judge in Brooklyn has instructed Indian billionaire Gautam Adani to respond to questions regarding potential exchanges related to the Justice Department’s decision to drop criminal charges against him.

In a court ruling released early Thursday, U.S. District Judge Nicholas G. Garaufis gave Adani until July 15 to clarify if he knows about any promises or agreements linked to the dismissal of the indictment against him. This inquiry comes amid growing tensions between the Justice Department and the court following the decision to let go of charges involving an alleged bribery scheme that involved over $250 million aimed at Indian officials for solar energy contracts.

The situation has raised eyebrows, especially since two prosecutors withdrew from the case after the dismissal was requested by higher-ups in the Department of Justice. Only politically appointed officials signed off on the motion to dismiss, which adds to the scrutiny of the decision. Previously, the Adani case had passed through scrutiny by the DOJ and the Securities and Exchange Commission, but this was later overturned by Principal Associate Deputy Attorney General Trent McCotter.

Sources indicate that McCotter and other officials met with attorneys representing Adani to discuss the case, leading to the controversial decision to drop the charges. In one meeting, it was reported that attorneys claimed dropping the charges could lead to a $10 billion investment in the American economy by Adani.

McCotter recently pushed back against the judge’s request for clarity on the dismissal, arguing that such inquiries could have negative impacts on future cases. He denied that any investment promises influenced his decision to drop the charges.

Judge Garaufis noted McCotter’s comments raised serious concerns about the possibility of an improper deal in connection with the indictment’s dismissal, suggesting a potential agreement that had not been reported to the court.

This dispute is not unique; the Justice Department has faced criticism from federal judges in similar cases before. Recently, a judge in New York questioned the dismissal of corruption charges against former Mayor Eric Adams, leading to significant fallout among prosecutors. Overall, these conflicts highlight ongoing tensions between judicial oversight and prosecutorial discretion.
