Elon Musk Testifies in High-Profile OpenAI Lawsuit

On Tuesday, Elon Musk took the witness stand in a significant trial concerning OpenAI, the organization behind ChatGPT. Musk asserts that he is suing OpenAI and its leaders, Sam Altman and Greg Brockman, to protect charitable donations and principles.

Musk, the wealthiest person in the world, claims that OpenAI has strayed from its original mission of serving humanity and instead has become focused on profit. He testified, “If we allow the misuse of charity, it could destroy the foundation of charitable giving in America. That’s my concern.” Musk, who is also the founder of Tesla and SpaceX, views OpenAI as a project he deeply invested in. “I came up with the idea, recruited the people, and provided all early funding,” he remarked, emphasizing that his intention was to create a charitable venture.

In his opening statement, William Savitt, a lawyer representing OpenAI and Altman, contended that Musk was actually motivated by profits. He alleged that Musk helped fund OpenAI with intentions of controlling it and only sued when things didn’t go his way. Notably, Musk has recently launched his own AI venture, xAI, part of SpaceX.

The trial continues with Musk expected to return to testify. His lawsuit seeks a hefty $150 billion in damages from OpenAI and Microsoft, a significant investor in the organization. Musk wants OpenAI to revert to a nonprofit status and calls for the removal of Altman and Brockman from their positions, claiming breach of trust and unjust enrichment.

During the trial, U.S. District Judge Yvonne Gonzalez Rogers warned Musk about his social media usage. She advised him to refrain from posting about the case after Musk labeled Altman as “Scam Altman” in recent tweets. Both Musk and Altman agreed to limit their social media activity during the proceedings.

This lawsuit shines a light on the personalities and dynamics that influenced OpenAI’s journey from a small nonprofit to a major player now worth over $850 billion. The outcome could impact both OpenAI’s plans for a possible public offering and general public perception of artificial intelligence.

Musk and Altman co-founded OpenAI in 2015 with the goal of benefiting humanity through advanced AI technologies. Musk expressed his long-standing concerns about the safety of AI, claiming past discussions with tech leaders like former President Obama and Google co-founder Larry Page, which led him to believe that there wasn’t enough emphasis placed on AI safety.

In contrast, Savitt argued that Musk did not prioritize safety and even criticized OpenAI staff who focused on it. Musk has claimed to have invested approximately $38 million into OpenAI and facilitated connections with major tech figures to help support the organization.

As the trial unfolds, OpenAI faces increasing competition from other tech firms, complicating its landscape. Meanwhile, Musk’s xAI remains a newcomer in the industry. OpenAI’s recent structural changes to become a public benefit corporation reflect its evolving goals, positioning it to potentially be valued at $1 trillion in the near future.
