Marketplace Overhaul
Representative Taylor Yarkosky has introduced a new bill aimed at revamping Florida’s Health Choices Program. The legislation, known as HB 141, proposes to rename the program to the Florida Employee Health Choices Program. The focus will shift to creating an employer-based health marketplace, allowing small businesses and their employees easier access to private health insurance options.
Initially set up in 2008 as a health insurance marketplace, the program struggled to gain traction and faced criticism after the introduction of the federal Affordable Care Act. Yarkosky’s bill seeks to better align the program with current health insurance regulations and integrate a model where employers can contribute tax-free dollars to their employees’ insurance plans.
If passed, the new program would establish a centralized online platform for employers and employees, streamline the enrollment process, and update eligibility requirements. The governance of this program would involve an eight-member board appointed by key state officials, including the Governor and legislative leaders. The changes are set to take effect on July 1, 2026.
Nursing Accountability
Republican Representative Toby Overdorf has refiled a bill aimed at enhancing accountability for Florida’s nursing education programs. The proposal, HB 121, echoes elements from a previous bill that was part of the “Rural Renaissance” initiative and had previously gained bipartisan support but faced the Governor’s veto.
The new legislation suggests stricter reporting, testing, and monitoring standards for nursing programs. It aims to improve support for students who may be struggling, ensure they receive early intervention, and implement a mandatory exit exam before graduation. Programs with low success rates on the National Council Licensure Examination (NCLEX) would face increased scrutiny, with possible probation or termination for non-compliance.
Supporters argue that these changes are essential to enhance nursing education in Florida, especially given the ongoing shortage of healthcare professionals in many areas. If approved, the bill would come into effect on July 1, 2026.
Expanding Autonomy
Senator Keith Truenow has introduced legislation to expand the practice scope for advanced nurse practitioners in Florida. His bill, SB 138, would allow psychiatric nurses to work independently without physician oversight, as long as they meet certain requirements set by the Board of Nursing.
This change would permit psychiatric nurses to assess, diagnose, and treat patients on their own, potentially helping to address the state’s pressing need for mental health services. Currently, specializations like primary care already allow for autonomous practice, but this expansion could make a significant difference in mental health care availability.
While a similar proposal made some progress in the House last year, it did not succeed in the Senate due to concerns about oversight and care quality. If passed, Truenow’s bill would take effect on July 1, 2026.
New Advocacy Role
The Florida Senior Living Association (FSLA) has welcomed Elaina Morgan as their new lobbyist, taking on the role of Director of Medicaid and Regulatory Support. Morgan brings over seven years of experience in health and Medicaid policy to her new position, where she will work to strengthen advocacy efforts for senior living initiatives.
Prior to joining FSLA, she served as a Legislative Analyst, providing policy guidance and evaluating health-related legislation. Her experience at the Agency for Health Care Administration included various roles focused on pharmacy policy, behavioral health, and specialized health services.
