Sydney Aims to Become a Leading Global Legal Hub

At a recent event in Sydney, a report titled Making the Case: Sydney as a Global Legal Hub was unveiled. This report, produced by the Committee for Sydney in collaboration with the Law Society of NSW and the Business of Cities, emphasizes Sydney’s potential to enhance its standing as an international legal center.

The study highlights that Sydney has robust advantages, including its common law system, respected courts, and commercial expertise, which position it well for global competition. However, it notes that the city is not always recognized as a key player in the international legal arena. The report points out that while there is significant legal activity locally, international arbitration in Sydney remains limited, leading to a mismatch between the city’s capabilities and its current role in international law.

One recommendation from the report is to promote the selection of NSW law as the preferred governing law in international commercial contracts. This strategy would not only encourage more disputes to be resolved in Sydney but also enhance its reputation in the field of arbitration, particularly at the Australian Centre for International Commercial Arbitration (ACICA).

The event took place at the Sydney offices of Gilbert + Tobin and included discussions on how other cities like Singapore, Dubai, and Dublin have successfully expanded their global legal presence through investment and strategic reforms.

Ronan MacSweeney, President of the Law Society, emphasized the significant economic potential this opportunity represents. He stated, “This could bring in hundreds of millions of dollars in legal services to our sector and to the NSW economy.” He acknowledged that while London and New York are seen as top legal hubs, jurisdictions such as Singapore have skillfully developed their international legal markets.

MacSweeney expressed pride in the local legal talent, highlighting that this initiative is not only about New South Wales becoming a major dispute resolution center. It is also about positioning Sydney as a prime location for global business transactions and legal services.

What Makes Sydney Unique?

The event featured a panel with insights from Diana Bowman of ACICA, Tala Bennett from Deloitte, and Sam Nickless of Gilbert + Tobin. Bowman pointed out Australia’s strong performance in enforcing arbitration agreements and maintaining a fair legal system, which is essential for attracting foreign business.

Bennett added that while legal clauses are often low-profile in contracts, it’s vital to promote the efficiency of Sydney’s courts and the quality of its legal environment. She stressed the need for potential clients to understand just how favorable Sydney’s legal landscape is.

Nickless addressed the challenge of geographical distance, suggesting that advancements in legal technology could help Sydney overcome this hurdle. He argued that flexibility in communication and workflows across different regions could position Sydney as a distinctive player in the global legal market.

In conclusion, Sydney is striving to boost its international legal profile, tapping into its existing strengths while learning from global counterparts. With continued efforts and strategic initiatives, Sydney aims to become a key destination for legal services worldwide.
