The United States has announced that it will not impose tariffs on certain specialty drugs and ingredients used to treat rare medical conditions that are imported from India and 19 other countries. This decision comes as the U.S. prepares to enforce a 100% tariff on some patented pharmaceutical products starting September 29.
The U.S. Commerce Department has released a list of countries that will benefit from this zero tariff rate, which includes India, Argentina, Bangladesh, Cambodia, Ecuador, El Salvador, members of the European Union, Guatemala, Indonesia, Japan, Jordan, Malaysia, North Macedonia, South Korea, Switzerland, Liechtenstein, Taiwan, Thailand, the United Kingdom, and Vietnam.
These medications include those for rare diseases, infertility treatments, cell therapies, gene therapies, and other specialized products. The announcement stated that not only the drugs but also the components used to manufacture them would be eligible for the zero tariff.
This move is part of a broader strategy initiated by former President Donald Trump to increase duties on certain pharmaceutical imports to boost domestic production. As a result, a proclamation was issued earlier this year that imposed significant tariffs on patented medications and their ingredients to promote the manufacture of these products within the U.S.
Under the terms of the proclamation from April, certain companies faced a 100% tariff that became effective on July 31 for some, with additional companies facing these tariffs starting on September 29. However, generic pharmaceutical products and associated ingredients remain exempt from these tariffs.
Furthermore, the latest notice includes some technical corrections to clarify definitions and ensure that they encompass unpatented animal health products. It also specifies that “pharmaceutical articles” refers to finished products and critical components needed for their production.
Overall, the zero tariff provision aims to strengthen trade relationships and provide critical medications while navigating the complexities of international trade policies.
