New Delhi: Controversy Surrounds CEC Gyanesh Kumar
In a developing situation regarding Chief Election Commissioner (CEC) Gyanesh Kumar, a new petition has been submitted to the Supreme Court (SC) calling for his suspension. The petition argues that the CEC should not be able to make unilateral decisions on behalf of the Election Commission (EC).
The petitioner, Rakesh Singh, is asking the court to declare that the recent Special Intensive Revision of electoral rolls and the decisions related to it are invalid and lack legal authority. Singh claims that around 14 decisions were made in the EC’s name despite objections from two other election commissioners, Sukhbir Singh Sandhu and Vivek Joshi.
The petition seeks clarity on the authority under which Gyanesh Kumar has been acting and asks the court to issue a directive compelling him to explain how he derives his power to make these decisions alone. “We request the court to issue a writ to Gyanesh Kumar to show the authority he claims to have in making these decisions,” the petition states.
This legal challenge highlights concerns over the decision-making process within the EC. A previous SC ruling in the T N Sheshan case established that in the event of differing opinions among the three election commissioners, the majority opinion should prevail, supporting democratic principles and preventing arbitrary actions.
Gyanesh Kumar has maintained that all decisions related to the Special Intensive Revision were made unanimously by the election commissioners.
This situation continues to unfold as stakeholders seek clarity and fairness in the commission’s operations.
