This ruling brings comfort to many immigrant families, including a large number of Indians living in the United States.

In a 6-3 vote, the Court rejected an effort by the Trump administration to limit automatic citizenship for children born in the US based on their parents’ immigration status. This means that any child born on American soil will be recognized as a citizen, no matter if their parents are on temporary work or student visas, undocumented, or awaiting permanent residency.

This ruling is especially good news for the Indian community. Many Indians in the US work under various visas, such as H-1B, L-1, and F-1. Additionally, over a million Indian nationals are caught in long wait times for green cards because of national limits on permanent residency. For these families, the shifting immigration rules have often caused anxiety.

Now, the Supreme Court has clarified that US-born children of these families are citizens from birth. Chintan Patel, Executive Director of Indian American Impact, described the decision as a strong message about who belongs in America. He noted that many children are born in the US long before their parents secure permanent residency.

Patel stated, “Today the Supreme Court looked at those families and said: ‘Your children are Americans. They belong here.’”

Congressman Raja Krishnamoorthi highlighted that this ruling reaffirms “a fundamental constitutional principle” that every child born in the United States is an American citizen, emphasizing that these rights cannot be changed through executive orders.

The Foundation for India and Indian Diaspora Studies (FIIDS) also praised the verdict, underscoring that birthright citizenship is essential to the immigrant experience and provides reassurance for countless families planning their lives in America.

The US Supreme Court recently made a significant decision that upholds a key part of the Constitution: birthright citizenship.
