Tucked into a spending bill that ended a lengthy government shutdown in November, this new rule, effective November 12, 2026, limits THC content to just 0.4 milligrams per container and bans compounds created outside of the hemp plant.<\/p>\n<h4>Addressing the Hemp Product Boom<\/h4>\n<p>The 2018 Farm Bill legalized hemp, defining it as any part of the plant with less than 0.3% delta-9 THC by weight. However, this legislation did not account for certain compounds known as cannabinoids, leading to what lawmakers call a loophole. This loophole sparked a surge in the production and sale of hemp-derived products like delta-8 THC and THCA, which can have intoxicating effects similar to marijuana but remain within the legal limits.<\/p>\n<p>Representative Dan Newhouse of Washington emphasized concerns about these products being easily accessible, stating, \u201cThese substances could be bought at local stores, even by kids.\u201d He criticized the lack of regulation, noting that packaging can be misleading.<\/p>\n<p>While delta-8 THC is naturally found in hemp, it\u2019s typically produced in much larger quantities through synthetic processes involving CBD. In recent years, reports of adverse reactions to delta-8 have surged, with 3,358 cases of exposure reported in 2022, up 82% from the previous year. These concerns have led the FDA to warn that delta-8 products have not been evaluated or approved for safe use.<\/p>\n<h4>Concerns Over Industry Impact<\/h4>\n<p>Critics argue that the new regulation could effectively ban hemp by redefining acceptable THC levels. The previous standard allowed for some non-intoxicating levels of THC, which many used to produce CBD wellness products, particularly in states where marijuana is still illegal.<\/p>\n<p>Mike Goettl, the president of Vuca Farms, expressed serious worries about the future of the hemp industry. \u201cIf we have to remove THC, it\u2019s an expensive and complicated process. This regulation means many businesses could be forced to close,\u201d he explained.<\/p>\n<p>Goettl is particularly concerned about the impact on wellness products. \u201cThis law would take away access to natural health solutions for millions of Americans,\u201d he said. CBD has become popular as an alternative for pain relief and managing various health issues, with anecdotal evidence suggesting it helps conditions like epilepsy and PTSD.<\/p>\n<h4>Calls for Better Regulation<\/h4>\n<p>Before the spending bill was passed, South Carolina Representative Nancy Mace condemned the hemp regulation as damaging to American farmers. A report suggested that the hemp industry is worth $28 billion, supporting over 320,000 jobs and generating $1.5 billion in state tax revenue. Senators Rand Paul and Thomas Massie also criticized the regulation, arguing it should not have been included in a crucial government funding bill.<\/p>\n<p>Despite these criticisms, Rep. Newhouse believes the regulation could help the industry grow in a more organized way.
