Josh Raffaelli has accused Brookfield Asset Management of fraud and attempted bribery in a lawsuit filed in California on Thursday.<\/p>\n<p>Raffaelli, who worked as a fund manager at Brookfield until late last year, claims that the company mistreated investors in his funds to cover losses in other areas of its business. His lawsuit, spanning 100 pages, highlights his close ties to Elon Musk, which allowed Raffaelli\u2019s funds the opportunity to invest in Musk&#8217;s private companies, a unique chance within the industry.<\/p>\n<p>Raffaelli alleges that Brookfield restricted the amount he could invest in one of Musk&#8217;s companies for its clients. His claims also note that he was fired shortly after submitting a whistle-blower complaint to the Securities and Exchange Commission.<\/p>\n<p>\u201cBrookfield repeatedly breached the trust of its investors and then dismissed the employee who brought these issues to light,\u201d said Raffaelli\u2019s lawyer, Mark Mermelstein.<\/p>\n<p>Brookfield manages over $1 trillion for various clients, including pension plans and government funds. In response to the lawsuit, Kerrie McHugh, a spokesperson for Brookfield, stated, \u201cThis lawsuit is entirely without merit, and these unfounded claims contradict Brookfield&#8217;s management practices. We will vigorously defend against these baseless accusations made by a disgruntled ex-employee.\u201d<\/p>\n<p>At 45 years old, Raffaelli has a long history in Silicon Valley. He began his career at Draper Fisher Jurvetson in 2004, just as Musk was starting to make his mark with SpaceX and Tesla. By 2009, Raffaelli was attending board meetings at both companies, which provided him unique investment advantages.<\/p>\n<p>In 2017, he joined Brookfield, managing a portfolio of technology funds. His base salary was reported at $500,000, but he was told his total compensation could reach into the tens of millions if his funds did well.<\/p>\n<p>Initially, Brookfield aligned its financial interests with Raffaelli&#8217;s funds, which managed more than $1.75 billion from various investors, including Brookfield itself. Tapping into his connections with Musk, Raffaelli was able to invest in several of Musk&#8217;s ventures.<\/p>\n<p>However, the company began facing financial difficulties, particularly due to the impact of the Covid-19 pandemic on the commercial real estate sector. This led Brookfield to shift its commitments, allegedly going back on promises to invest alongside outside investors in Raffaelli&#8217;s funds.<\/p>\n<p>Raffaelli\u2019s lawsuit claims that these changes limited the amount of capital available for investments, ultimately hurting the potential returns for Brookfield&#8217;s clients. At one point, he was forced to cut back a planned investment in Musk\u2019s artificial intelligence company xAI from $25 million to only $5 million.<\/p>\n<p>The lawsuit described missed investment opportunities as significant, likening it to missing out on buying early shares of major companies like Facebook or Apple. Since then, xAI&#8217;s valuation has soared.<\/p>\n<p>Last year, Brookfield raised concerns about merging Raffaelli&#8217;s funds with another company, Pinegrove Capital Partners. Upon investigating Pinegrove, Raffaelli reportedly discovered that the company\u2019s financial health was exaggerated, leading to false promises made to clients. <\/p>\n<p>Following his whistle-blower complaint to Brookfield\u2019s internal reporting system and the SEC, Raffaelli says he was fired, just days later.
