A recent ruling from an Indian court has brought good news for multinational companies. The court decided that offering remote services across borders does not automatically mean these companies owe corporate tax in India.
In a notable case, the Bombay High Court ruled on March 27 that technical services provided online by a foreign company to its Indian branch are not the same as services performed in India. If services were done in-person in India, they would attract taxation.
This ruling came from a writ petition filed by Benteler Automotive (China) Investment Ltd., which is a tax resident of China and part of the Austria-based Benteler Group, known for manufacturing automotive parts.
This decision clarifies that remote services do not create a tax obligation in India, a stance that could benefit many companies operating globally.
